Terms and Conditions of Service
The DataTalk service is provided by DkR S.r.l., a company with its registered office listed in the Milan Economic and Administrative Index (R.E.A.) under no. 1960376, in the Milan Companies Register, with tax code and VAT number 07459820960. DataTalk is an online business intelligence software platform that enables users to analyse, visualise and interpret business data. Purchase of the service entails the granting of a non-exclusive, non-transferable licence of limited duration.
Purchases are made via the datatalk.bi website. Upon completion of the order, the user proceeds to make an online payment, and a personal account is created at the same time, granting immediate access to the platform. The service may involve the payment of a monthly fee and, in some cases, a one-off initial activation fee.
Licences are subject to automatic monthly renewal. Renewal is processed using the payment method specified by the user at the time of purchase. The user can disable automatic renewal at any time via their account, thereby avoiding charges for subsequent periods.
For certain types of licence, a 7-day free trial period may be available. Unless you cancel by the end of the trial period, your subscription will be activated automatically and you will be charged the relevant fee.
The user undertakes to use the service in accordance with applicable legislation and these terms and conditions. Reverse engineering, decompilation or attempts to access the source code are expressly prohibited, as is the resale, sub-licensing or distribution of the service to third parties without authorisation. Any use that is unlawful or inconsistent with the purposes of the service is also prohibited.
The service is provided “as is”. DkR S.r.l. does not guarantee that the platform will be free from errors or interruptions, nor that it will meet the user’s specific requirements. To the extent permitted by law, the company shall not be held liable for any indirect damages, loss of data, loss of profit or other consequences arising from the use of the service.
DkR S.r.l. reserves the right to suspend or terminate access to the service in the event of a breach of these terms and conditions or misuse of the platform.
The company also reserves the right to amend these terms at any time. Any amendments will take effect upon their publication on the website.
These terms are governed by Italian law.
RIGHT OF WITHDRAWAL
Under Articles 52 et seq. of the Consumer Code, the consumer has the right to withdraw from the contract within 14 days of completing the purchase. However, this right does not apply to the supply of digital content via non-material media, such as online software services, once the service has begun.
By purchasing a DataTalk licence, the user expressly requests the immediate activation of the service and agrees that performance shall commence immediately following payment. Consequently, in accordance with Article 59 of the Consumer Code, the right of withdrawal ceases to apply once access to the platform is made available.
As the account is activated immediately upon purchase, the service is deemed to have commenced at the time the account is created. For this reason, no refunds will be issued after activation. However, you may cancel your subscription at any time to prevent it from renewing for subsequent periods.
If a free trial period is offered, the user may cancel at no cost during the trial period. Once this period has ended, the standard subscription terms and conditions apply.
The right of withdrawal provided for in the Consumer Code applies exclusively to consumers. Customers purchasing in their capacity as professionals or businesses are not entitled to a right of withdrawal, unless otherwise stated.
